App Terms of Use

Welcome to the Aupine app. These App Terms of Use ("Terms") govern your access to and use of the Aupine mobile application and any related features, services, content, and functionality provided through the app (collectively, the "App").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. About Aupine

Aupine provides an online platform through which users may browse, discover, and purchase wellness, supplement, personal-care, tea, pet supplement, and other products offered through the App.

Product availability and features may vary by location and may change without notice.

5. Products and Product Information

Aupine attempts to provide accurate product descriptions, images, prices, ingredients, availability, and other information.

However, product information may occasionally contain errors or become outdated. Product packaging, labels, ingredients, warnings, directions, and other information may change.

You should always review the information provided with the product before using it.

Aupine does not guarantee that product descriptions, images, specifications, pricing, or other information are complete, accurate, or current at all times.

6. Health and Wellness Disclaimer

The App may contain information relating to supplements, wellness products, nutrition, personal care, or pet wellness.

Such information is provided for general informational purposes and is not medical, veterinary, or professional advice.

Aupine products and information are not intended to diagnose, treat, cure, or prevent disease unless expressly stated and permitted under applicable law.

You should consult a qualified healthcare professional or veterinarian before using products when appropriate, particularly if you have an existing medical condition, take medication, are pregnant or breastfeeding, or have other health concerns.

7. Orders and Purchases

When you place an order through the App, you agree to provide accurate and complete billing, shipping, and payment information.

Submitting an order does not necessarily mean that the order has been accepted. Aupine reserves the right to accept, reject, limit, or cancel orders for legitimate reasons, including product availability, pricing errors, suspected fraud, or other circumstances.

If an order is canceled after payment has been received, any applicable refund will be handled according to Aupine's refund policy and applicable law.

Subscription orders are subject to Aupine's Subscription Policy, including provisions regarding recurring charges, renewals, cancellations, payment methods, and refunds.

By subscribing, you authorize recurring charges according to the terms presented at checkout.

10. Payments

Payments may be processed by third-party payment providers.

By submitting payment information, you authorize the applicable payment provider to process charges associated with your purchases.

Aupine does not necessarily store complete payment-card information and may rely on third-party payment providers to securely process transactions.

11. Intellectual Property

The App and its contents, including but not limited to text, graphics, logos, photographs, product information, designs, software, interfaces, trademarks, service marks, and other materials, are owned by or licensed to Aupine and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms or applicable law, you may not reproduce, modify, distribute, publish, display, sell, license, or otherwise exploit any part of the App without prior written permission.

Nothing in these Terms grants you ownership of Aupine's intellectual property.

12. User Content

If the App allows you to submit reviews, comments, photographs, feedback, or other content ("User Content"), you retain ownership of your User Content.

By submitting User Content, you grant Aupine a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and publish that content as reasonably necessary to operate, promote, improve, or provide the App and its services.

You represent that you have the necessary rights to submit the User Content and that it does not violate any applicable law or third-party rights.

Aupine reserves the right to remove User Content that violates these Terms or applicable law.

13. Reviews and Feedback

Product reviews and other user-submitted feedback should be truthful and based on your genuine experience.

You must not submit misleading, fraudulent, defamatory, abusive, or irrelevant reviews.

You must not submit reviews in exchange for improper compensation or incentives unless the nature of the relationship is appropriately disclosed where required by law.

14. Third-Party Services

The App may integrate with or contain links to third-party websites, applications, payment providers, shipping services, analytics services, or other third-party services.

Third-party services are governed by their own terms and privacy policies.

Aupine does not control and is not responsible for third-party services, content, availability, security, or practices.

15. App Store Terms

If you download the App through a third-party app store, including the Apple App Store or Google Play, your use of that store is also subject to the applicable store's terms and policies.

These Terms are between you and Aupine and not with the applicable app-store provider, except to the extent otherwise required by the applicable store's terms.

16. Privacy

Your use of the App is also subject to Aupine's applicable Privacy Policy, which explains how information may be collected, used, stored, and disclosed.

By using the App, you acknowledge that you have reviewed the applicable Privacy Policy.

17. Security

Although Aupine takes reasonable measures to maintain the security and reliability of the App, no website, application, network, or electronic transmission can be guaranteed to be completely secure.

You use the App at your own risk and are responsible for maintaining appropriate security of your device and account credentials.

18. Availability and Changes to the App

Aupine may modify, suspend, restrict, or discontinue all or part of the App at any time.

Features, products, content, functionality, and availability may change without notice.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or operating system.

19. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the App and its content are provided on an "as is" and "as available" basis.

Aupine disclaims warranties and representations that cannot be guaranteed under applicable law, including warranties concerning availability, accuracy, reliability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes any consumer rights or legal protections that cannot lawfully be excluded.

20. Limitation of Liability

To the fullest extent permitted by applicable law, Aupine and its affiliates, officers, employees, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the App or products purchased through it.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Aupine and its affiliates, officers, employees, agents, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from:

• Your violation of these Terms.

• Your misuse of the App.

• Your violation of applicable law.

• Your infringement of another person's rights.

• Content you submit through the App.

22. Suspension or Termination

Aupine may suspend or terminate your access to the App or your account if we reasonably believe that you have violated these Terms, applicable law, or otherwise misused the App.

You may stop using the App at any time.

Termination does not affect rights or obligations that, by their nature, should survive termination.

23. Changes to These Terms

Aupine may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the top of this page. Where required by applicable law, we may provide additional notice.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable to Aupine and your use of the App, without regard to conflict-of-law principles, except where applicable consumer-protection laws provide otherwise.

Any dispute arising from these Terms will be handled in accordance with applicable law and any mandatory consumer rights or dispute-resolution requirements.

25. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

26. Entire Agreement

These Terms, together with any policies or terms expressly incorporated by reference, constitute the agreement between you and Aupine regarding your use of the App, except where additional terms apply to a specific service or transaction.
